Information for customers and suppliers pursuant to EU Regulation 679/2016

WHY THIS NOTICE

We hereby inform you that in order to manage and perform relations with its stakeholders and partners, Brianza Plastica Spa needs to acquire, through its website, verbally, directly or through third parties, data qualified as “personal data” pursuant to EU Regulation 679/2016.
For this purpose, pursuant to articles 13 and 14 of said Regulation, we invite you to read this policy.

DATA CONTROLLER

PROCESSING METHOD

Our company, as Data Controller, will manage and store the personal data collected for the purposes indicated below using automated and/or paper-based instruments.
As provided for by article 32 of EU Regulation 679/2016, specific security methods are followed to prevent loss, illegal or improper use and unauthorised access of data.
The information will be kept for the time necessary to manage the contractual relationship and to fulfil the legal obligations.

PURPOSE OF THE PROCESSING AND LEGAL BASIS: obligation and right of data provision

Brianza Plastica will only acquire and process personal data and, if necessary, fiscal data; in no case will it process data that can be defined as “special” in accordance with art. 9 of EU Regulation 679/2016.
Your personal data will be processed for the following purposes:

  1. To fulfil the precontractual and contractual obligations, and to manage the contractual relationship (e.g. activities for concluding the contract, billing, pre- and post-sales support, etc.);
  2. To perform the contract;
  3. To exercise the legitimate rights and interests of the Data Controller, such as the economic-financial evaluation, request for documentation attesting to the possession of specific requirements, the right of defence in legal proceedings, administrative and accounting operations connected to internal organisational requirements, and internal accounting controls;
  4. To fulfil the obligations provided for by the current regulations with regard to Public Administrations, also related to the contractual relationship.

The legal bases of the processing are the execution of precontractual and contractual measures between the parties, the fulfilment of legal obligations as well as the legitimate interest consisting of the need to guarantee the proper functioning of the internal organisation.
Therefore, the processing of personal data referred to in letters a) b) c) and d) is lawful and does not require prior consent in accordance with article 6 of EU Regulation 679/2016.
The provision of data for the aforesaid purposes is optional, however the failure to provide said data shall make it impossible to conclude the contract or provide the requested services.

RIGHTS OF DATA SUBJECTS

Data subjects are guaranteed all the rights set forth in articles 15, 16, 17 and 18 of EU Regulation 2016/679 (access with confirmation of the existence or not of personal data; rectification, cancellation and restriction of processing, if necessary).
The data subject has the right to revoke the consent given for processing purposes at any time, and to oppose, for legitimate reasons, the processing for marketing purposes.
